This is the last Will and Testament
1. Of Sarah Quincy of Albion House Albion Place in the Parish of
2. Christchurch in the County of Surrey Widow First I direct that all
3. my iust [ie just] debts and my funeral and testamentary expenses shall be
4. fully paid also I desire that my Remains may be interred in the
5. Cemetery at Kensall Green in a Vault to be purchased by my
6. Executors and that the Remains of my late husband Joseph
7. Quincey Esquire be removed to the same Cemetery from the vault
8. under the Church of Saint George the Martyr Southwark where
9. they now lie and that my Friend Mr John Pike of Old Burlington
10. Street in the County of Middlesex Solicitor do take the necessary
11. steps to carry my wishes on this subject into effect I give and devise
12. unto my Friend Samuel Edwin Bean of Little Wigborough in the
13. County of Essex Esquire and to his heirs all that my Farm and
14. lands situate at Little Wigborough aforesaid now in his own
15. occupation To hold the same to him his heirs and assigns forever for
16. his and their absolute benefit I give devise and bequeath all
17. other my freehold farmlands estates heraditaments and also
18. all my leasehold messuages lands estates and premises with their
19. respective appurtenances unto and to the use of my Friends the said

2. Samuel Edwin Bean Charles Christmas of Spring Gardens in the
3. County of Middlesex Esquire and Richard Cooper Gray of upper
4. stamford street in the parish of Christchurch aforesaid Esquire whom
5. I herein nominate to be my trustees and to their heirs executors
6. administrators and assigns respectively according to the respective
7. natures thereof and for all the estate term and interest which I may
8. have therein respectively at my decease upon the trusts following
9. that is to say upon Trust in the discretion of the trustees or trustee
10. for the time being of this my will to sell the same as soon as
11. convenient after my decease either together or in parcels and either
12. by public auction or private contract for the best price or prices that
13. can be reasonably obtained for the same and I direct that the
14. purchase monies to arise by such sale or sales as aforesaid shall
15. fall into and constitute a part of my residuary estate thereinafter
16. disposed of And Whereas I am entitile to divers copyhold of
17. customary tenements lands or estates situate in the counties of
18. Essex and Surrey Now I do empower and imperatively direct the
19. trustees or trustee for the time being of this my will as soon as
20. convenient after my death in their or his discretion to sell my said
21. copyhold or customary estates either together or in parcels and
22. either by public auction or private contract for the best price or
23. prices that can be reasonably obtained for the same and I direct
24. that the purchase monies to arise from the sale of my said
25. estates shall fall into and constitute a part of my personal estate
26. hereinafter disposed of Provided nevertheless and I hereby expressly
27. declare such sale of my said copyhold or customary estates so
28. directed to be made as aforesaid shall be made only during the
29. lives of my said trustees hereby nominated or during the lives
30. or life of the survivors or survivor of them or within twenty one
31. years after the deaths of such survivor and I give unto Richard
32. Humber of Burton Crescent in the said county of Middlesex Esquire
33. such one of the two portraits of my late husband in my possession as
34. he may select and the other of such portraits I give to the said
35. Richard Cooper Gray and I give unto the said John Pike the
36. Portrait of Charles James Fox in my possession and I give unto my
37. Friend Ann Day so many and such parts of the household goods
38. and furniture which shall be in my dwelling house in Albion
39. Place aforesaid at the time of my decease as she shall choose and
40. select for her own absolute use and as to and concerning all the rest
41. of my goods and chattels and all other my personal estate and effects
42. whatsoever I give and bequeath the same unto my said trustees
43. the said Samuel Edwin Bean Charles Christmas and Richard
44. Cooper Gray their executors administrators and assigns upon trust
45. with all convenient speed after my decease to sell and convert the
46. same into money and as to and concerning all the monies to arise
47. from the sale and conversion of my said freehold leasehold and
48. copyhold estates and of my said residuary personal estate herein
49. before respectively devised bequeathed and directed to be sold and
50. converted into money as aforesaid I give and bequeath the same
51. unto the said Samuel Edwin Bean Charles Christmas and Richard
52. Cooper Gray their executors and administrators and do direct them
53. to have stand possessed and pay apply and dispose of the same
54. upon the trusts and for the purposes following (that is to say)
55. First in Trust to pay and satisfy all my just debts and funeral
56. and testamentary expenses and also such of the several
57. legacies and annuities bequeathed by the will of my late

41 my Servant Mary White the sum of fifty pounds and To The Guardian
42 Society in the New Road Saint Georges in the East the sum of one
43 hundred pounds and my will is and I direct that all the aforesaid
44 legacies shall be paid at the expiration of twelve calendar months
45 next after my decease and that the said Legacy of one hundred pounds
46 to the Guardian Society shall be payable out of my personal estate
47 only and shall not be chargeable upon or payable out of any of my
48 freehold leasehold or copyhold estates or any monies to arise from
49 the said thereof respectively and I further direct my trustees and trus-
50 tee for the time being to set apart and invest a sufficient sum of
51 money in the public funds of Great Britain to produce by the dividends
52 thereof a clear annual sum of three hundred pounds and pay such
53 annual sum or dividends as they shall become due to the said Ann
54 Day for her life and immediately after her decease then from and
55 out of the principal of the funds so set apart to answer the said
56 annual sum to pay to the said Samuel Edwin Bean the sum of
57 one thousand pounds sterling and unto such person or persons as the

1. said Ann Day shall by her will or any Codicil appoint the further sum
2. of one thousand pounds sterling and to permit the residue of the said
3. funds so set apart as aforesaid to fall into and become part of my resi-
4. duary estate hereinafter disposed of and I further direct my said
5. trustees and trustee for the time being to pay unto my Cook Elizabeth
6. Pickaro the clear yearly sum of fifty pounds sterling during her life and
7. to set apart and invest a sufficient sum in the public funds of Great
8. Britain for that purpose and as to all the surplus rest and residue of
9. the said trust monies personal estate and premises (charged nevertheless
10. with such duties as are hereinafter mentioned) I hereby give and
11. bequeath the same unto the said Richard Humber his executors
12. administrators and assigns absolutely and I direct that the duties
13. payable to Government in respect of all the aforesaid legacies and
14. annual sums shall be paid and discharged out of the said surplus or
15. residue of my said estate so given to the said Richard Humber as afore-
16. said and for the more effectually executing the trusts and directions afore-
17. said I hereby declare that the receipt and receipts of the trustees and
18. trustee for the time being of this my will or such of them as shall from
19. time to time act in the due execution thereof shall effectually discharge
20. every or any purchaser of my said freehold copyhold leasehold and
21. personal estate or any part thereof and every or any person paying
22. any monies to my said trustees or trustee under or in pursuance of
23. this my will or the trusts powers or directions thereof for so much
24. monies as in such receipt or receipts shall be acknowledged to be
25. received and no such purchaser or other person shall afterwards be
26. responsible for the loss or misapplication of such monies or of any
27. part thereof and my will further is that upon or previously to any sale
28. or sales of my said freehold copyhold and leasehold estates or any
29. or any part or parts thereof it shall be lawful for her [the] [Note 1] trustees and trustee
30. for the time being of this my will to make any general or
31. special conditions or stipulations touching the title or otherwise in
32. reference to the same estates or any part or parts thereof and no
33. purchaser of the same estates or any of them or any part thereof
34. respectively shall be bound to enquire into the necessity or propriety
35. of such conditions or any of them or shall be at liberty to object thereto
36. or be affected by notice that the same or any of them are unnecessary
37. or improper and I hereby empower my said trustees or trustee for
38. the time being to buy in the said estates or any of them or any
39. part thereof respectively at any auction or auctions and to rescind
40. any contract for sale and in every such case to resell the premises
41. by public auction or private sale without being liable for any loss that
42. may arise by so doing and I hereby declare that if my trustees here-
43. in nominated or any of them or any trustees or trustee to be nomi-
44. nated under this power shall die or neglect or be or become unwilling
45. or incapable to act in the trusts or powers of this my will it shall be
46. lawful (as often as the same shall happen) for the surviving or
47. continuing trustees or trustee for the time being of my will or the
48. executors or administrators of any deceased trustee by any deed in
49. writing to appoint any other person or persons to be a trustee or
50. trustees in the place of the trustee or trustees who shall so die or
51. neglect or be or become incapable or unwilling to act and on every
52. such appointment I direct all the trust estates funds monies and
53. premises for the time being \to/ be conveyed assigned and transferred
54. unto and effectually vested in the new trustee or trustees solely or
55. jointly with the continuing trustee or trustees as the case may
56. require and I declare that the trustees and trustee for the time being
57. of this my will shall be competent to exercise all the powers hereby

3 being of my will respectively shall not be answerable for each others
4 acts deeds receipts or defaults nor for involuntary losses and that each
5 and any of them as shall and may out of any monies which
6 shall come to his or their respective hands by virtue of my will retain
7 or allow to his or their co[-]trustee or co[-]trustees all costs and expences
8 whatsoever which may be occasioned by the sale or conversion of my
9 said freehold leasehold copyhold and personal estates or any of
10 them or any part or parts thereof or which may otherwise arise
11 from or be incident to the execution of the trusts or powers of this my
12 will and I hereby nominate and appoint the said Samuel Edwin
13 Bean Charles Christmas and Richard Cooper Gray Executors in
14 trust of this my will and I revoke all former wills and declare this
15 only to be my last will and Testament In Witness whereof I the

25 the County of Surrey Widow which bears date on or about the twenty
26 fourth day of December One thousand eight hundred and forty one
27 Whereas by my said will I have, after a certain devise therein
28 contained[,] devised and bequeathed all other my Freehold Farms Lands
29 Estates and Hereditaments and also all my leasehold messuages
30 lands estates and premises and also all the rest of my goods chattels
31 and personal estate and effects (not therein specifically devised or
32 bequeathed) unto Samuel Edwin Bean of Little Wigborough in the
33 County of Essex Esquire Charles Christmas of Spring Gardens in the
34 County of Middlesex Esquire and Richard Cooper Gray of Upper
35 Stamford Street in the Parish of Christchurch aforesaid and their
36 heirs executors administrators and assigns upon certain trusts and
37 for certain purposes and with certain powers in my said will
38 expressed containing the same and I hereby bequeathed to the said
39 Richard Cooper Gray the sum of five hundred pounds and also one
40 of the portraits of my late husband and by my said will I declared
41 that the said Samuel Edwin Bean Charles Christmas and Richard
42 Cooper Gray should be the trustees of my said will and I have
43 empowered them to sell my copyhold estates as therein mentioned
44 and I have also nominated the said Samuel Edwin Bean Charles
45 Christmas and Richard Cooper Gray executors in trust of my said
46 Will and whereas since the execution of my said will the said Richard
47 Cooper Gray has become Bankrupt Now therefore I hereby revoke
48 the bequest of the said sum of five hundred pounds and of the
49 Portrait of my said husband which by my said will I have
50 given to the said Richard Cooper Gray and I also hereby revoke
51 and make void every devise power and bequest in my said will
52 contained and also the said appointment of executors and trustees so
53 far only as the same devises bequests and appointment respectively
54 relate to or concern the said Richard Cooper Gray as trustee
55 Executor and legatee respectively of my said will but no further or
56 otherwise and I hereby direct and declare that my said will shall

1 be read and construed and shall have the same operation and effect
2 in all respects as if the name of the said Richard Cooper Gray had
3 never been inserted therein either as trustee executor legatee or other-
4 wise and I bequeath the portrait of my late husband which in my
5 said will is given to the said Richard Cooper Gray and also the
6 further sum of one hundred pounds (in addition to the legacy or sum
7 of one hundred pounds by my said will given) to my Friend Mr John
8 Pike of Old Burlington Street in the County of Middlesex Gentleman
9 and I direct that the said last mentioned legacy shall be payable
10 at the same time and in the same manner as the said legacy of one
11 hundred pounds in my said will given and bequeathed to the said
12 John Pike and in all other respects I confirm in my said Will in
13 Witness whereof I the said Sarah Quincey have hereunto set my

21 Sarah Quincey of Albion House Albion Place in the Parish of Christchurch
22 in the County of Surrey Widow which bears date on or about the
23 twenty fourth day of December One thousand eight hundred and
24 forty one Whereas by my said will I have given four hundred
25 pounds to Clara Cubitt of the City of Norwich Widow And Whereas
26 the said Clara Cubitt hath recently departed this life whereby the
27 said legacy hath become lapsed Now therefore I do give and
28 bequeath the sum of four hundred pounds unto and between such
29 of the children of the said Clara Cubitt as shall be living at the time
30 of my decease in equal proportions share and share alike and
31 I direct that the said last mentioned legacy shall be payable at
32 the same time and in the same manner and out of the same
33 fund as the said legacy of four hundred pounds by my said will
34 payable And Whereas by my said will I have given to George
35 Johnson of Gearing near Ilford in the County of Essex the sum of
36 two hundred pounds and whereas the said George Johnson is in
37 a declining state of health Now therefore in the event of the said
38 legacy of two hundred pounds becoming lapsed by the death of the
38 said George Johnson in my lifetime I do give the sum of two
40 hundred pounds to Elizabeth his wife and I direct the said last
41 mentioned legacy (if payable) shall be payable at the sametime
42 and in the same manner and out of the same fund as the said
43 legacy of two hundred pounds by my said will given and
44 bequeathed to the said George Johnson would have been payable
45 and I give and bequeath to Sophia the daughter of my Servant
46 James Perman the sum of three hundred pounds and I direct that
47 the said legacy of three hundred pounds shall be payable at
48 the same time and in the same manner and out of the same
49 fund as the legacy by my said will given to the said James
50 Perman and in all other respects I confirm my said will In
51 Witness whereof I the said Sarah Quincey have hereunto set
52 my hand this twenty ninth day of August One thousand eight

5. hundred and forty one I give bequeath to Edward Doubleday
6. of Blackfriars Road in the County of Surrey Surgeon the sum of two
7. hundred pounds and I give and bequeath to my servant William
8. Eales the further sum of one hundred pounds in addition to the
9. legacy or sum of two hundred pounds by my said will given to
10. him and I direct that the said legacy to the said Edward Doubleday
11. and the said additional legacy to the said William Eales shall be
12. payable at the same time and in the same manner and out of
13. the same fund as the said legacy of two hundred pounds by my
14. said will given and bequeathed to the said William Eales and I
15. direct my executors to find and provide all the Servants who shall
16. form part of my Establishment at the time of my decease with
17. suitable mourning and in all other respects I confirm my said will
